1. Purpose
These Terms of Service govern the access to and use of the Prepashow service, an online platform for preparing dance shows, accessible at https://www.prepashow.com.
Use of the service implies full and complete acceptance of these terms.
2. About the service
Prepashow offers dance schools, companies and choreographers a tool to manage their shows: structure (acts, pieces), casting (dancers, costumes, sets), audio management (MP3), PDF exports, sharing between collaborators.
Prepashow is a private technical management tool, not a public broadcasting platform. Audio files uploaded by the user are accessible only to them and to the collaborators they explicitly invite. The publisher does not host any content intended for public listening or commercial use.
3. Registration and user account
Use of the service requires creating an account with a valid email address. The user agrees to provide accurate information and to keep it up to date.
The user is responsible for the confidentiality of their password and for any activity on their account.
4. Pricing plans
The service offers two plans:
- Free: limited features (1 show, no exports or sharing)
- Premium: annual subscription at €100/year incl. VAT, unlimited features
Payment is secured by Stripe. The Premium subscription auto-renews each year. The user may cancel at any time from their account; the cancellation takes effect at the end of the current period.
In accordance with article L221-28 1° of the French Consumer Code, the consumer user expressly acknowledges that the execution of the service begins upon subscription. By subscribing to the Premium plan, they request immediate execution of the service and expressly waive their fourteen (14) day right of withdrawal for features already used at the time of any withdrawal request.
5. Intellectual property and copyright
The Prepashow service (interface, code, logos, brand) is the exclusive property of the publisher. Any reproduction, copy or imitation is prohibited without prior written authorization.
Content uploaded by the user (MP3, photos, texts) remains the property of the user or their rights holders. The user warrants that they hold the rights necessary for use within Prepashow and releases the publisher from any liability in case of copyright infringement.
Public broadcasting of music (collecting societies such as SACEM, SACD). The user acknowledges that Prepashow is a private technical management tool and not a public broadcasting platform. The user is solely responsible for obtaining, from the relevant collecting societies (SACEM in France in particular), the authorizations and licenses necessary for the public broadcasting of music during their shows, public rehearsals, or any other public use. The publisher cannot be held responsible for a user's missing license.
6. Service availability
The publisher strives to keep the service accessible 24/7 but does not guarantee 100% availability. Interruptions may occur for maintenance or for reasons beyond the publisher's control.
7. Liability
The publisher commits to providing the service with reasonable diligence. The user is encouraged to keep a copy of their important content (PDF exports, local backups of original MP3s).
The publisher cannot be held liable for indirect damages (loss of revenue, loss of business, commercial or reputational harm) resulting from use of the service.
In any event, and in accordance with French law, the publisher's liability for any proven damage is limited to the total amount paid by the user during the twelve (12) months preceding the event giving rise to liability.
8. Force majeure
The publisher cannot be held responsible for the non-performance or interruption of the service in case of force majeure, as defined by French law and case law: global internet outage, major incident at the hosting provider, large-scale cyberattack, decision by a public authority, or any other unforeseeable and unavoidable event.
9. Prohibited use
The user is expressly prohibited from:
- attempting to copy, decompile, disassemble or reverse-engineer all or part of the service code;
- using bots, robots, scripts or scraping tools to mass-extract data from the service;
- attempting to bypass security measures or technical limits (storage quotas, freemium gating, etc.);
- using the service for unlawful or fraudulent purposes, or to infringe the rights of third parties;
- sharing their credentials with a third party in any way that bypasses the intended sharing system (see Premium collaborator feature).
Any breach of these prohibitions may result in immediate suspension of the account without notice.
10. Personal data
The terms for processing personal data, as well as the list of subcontractors and retention periods, are detailed in the Privacy.
11. Changes to the terms
The publisher reserves the right to modify these terms at any time. Users will be notified of changes by email or via the service. Continued use after notification constitutes acceptance.
12. Account termination
The user may delete their account at any time from their personal area. Deletion results in the permanent erasure of all their data, except for billing data retained under legal obligations (see privacy policy).
The publisher may suspend or delete an account in case of breach of these terms.
13. Applicable law - Disputes
These terms are governed by French law. In case of dispute, an amicable solution will be sought before any legal action. Failing this, the French courts shall have exclusive jurisdiction.
